Stop the Trial of Geert Wilders

What started as a trial against Geert Wilders for alleged Islamophobia has nearly turned into its opposite: a historical case about the message of the Quran. The Amsterdam court trying the controversial Dutch politician is now preoccupied with the question of whether this book, sacred to more than a billion believers, can be compared to one of the most vile publications in the history of Western civilization—Hitler’s “Mein Kampf.” What could possibly go wrong?

In his writing and speeches, Mr. Wilders has found these two works to be similar in terms of their anti-Semitism and incitement to hatred, and has thus called for a publishing ban on the Quran similar to the one in place for “Mein Kampf.” This is what triggered Mr. Wilders’s prosecution for discriminatory and insulting remarks against Muslims and Islam. The Dutch politician, though, denies having insulted Muslims. He insists his focus is on radical Islam and the Quran, which he considers to be not only a religious text but also a political pamphlet encouraging Muslims to discriminate against and, if necessary, kill Jews, Christians, apostates and other unbelievers. That’s why Mr. Wilders claims the right to criticize and condemn Islam.

Following complaints brought by mostly Muslim and radical leftist activists, Amsterdam’s district attorney in 2008 at first found no legal basis for prosecuting Mr. Wilders. Prosecutors were forced to change course only after an activist appeals court last year ordered Mr. Wilders’s prosecution—basically condemning the politician before any trial could even begin and before Mr. Wilders had a chance to defend himself. The court’s unusual intervention illustrates the Dutch confusion about the conflict between two essential rights: the right to free speech and the right to protection from discrimination.

Our Flemish correspondent VH has translated another batch of material on the Geert Wilders trial, which begins on Wednesday in Amsterdam. He includes these introductory notes:

There are rumors that the Dutch Minister of Justice, Ernst Hirsh Ballin, who was seen as the key player behind the curtains in the arrest of Gregorius Nekschot in 2008, is also influencing or “steering” the prosecutors in the Wilders trial. Bram Moszkovicz, Wilders’ lawyer, points in that direction between the lines of the De Telegraaf interview below.
Both prosecutors who have been assigned to the Wilders trial, Mr. P. (Paul) Velleman and Miss B. van Roessel, also work for the LECD [National Discrimination Expertise Center] and are being assisted in the Wilders trial by the (policy) employees of the LECD. Paul Velleman is the prosecutor and the head of LECD.: “After release, he was told: You can forget about anonymity now. They know who you are.“
Paul Velleman was the prosecutor who had the cartoonist Nekschot picked up in a raid by ten police officers in the middle of the night, and kept him locked up for more than two days. Quote from H. Numan

Paul Velleman has close ties to the anti-discrimination industry and is also in charge of the Justice Ministry department LECD (National Expertise Center against Discrimination).

In the past he has defended top criminals such as Cor van Hout and Willem Holleeder [Heineken kidnappers] and the failed coup d’état leader and former military dictator of Surinam Desi Bouterse. His latest client is no less controversial. PVV leader Geert Wilders is hated, adored, and now also prosecuted. Moszkovicz now has the task of defending Wilders against charges of discrimination, group hatred, and discriminating hatred against Muslims. He did not need to think for long before taking on the assignment; “Wilders says nothing punishable.” 

The majestic Amsterdam canal building where the Moszkovicz law firm is housed breathes of grandeur. It is clear: Geert Wilders has chosen one of the top lawyers in the Netherlands. The amiable criminal lawyer (49) made time available between two cases to comment on his strategy for the upcoming trial. He looks relaxed, but knows exactly what he can and cannot say.
In his office his father, the renowned Max Moszkovicz, casts an approving glance. Another painted portrait shows Marlin Brando as the Godfather Don Corleone and hangs on the wall as provocative art. The lawyer is not shy of media attention, as proven by his appearances in TV shows. For the next few months the spotlight will again be on him when he stands alongside Geert Wilders, who must defend himself for his crusade against Islam.
The PVV leader already speaks of a “political trial” and “North Korean circumstances”. If he is convicted, he may be sentenced to nearly two years imprisonment. Moszkovicz will open his entire box of tricks to prevent that from happening. In an exclusive interview with the Dutch newspaper De Telegraaf, the counsel expresses his concern about the prosecution, which he suspects of high-level chicanery.
Did you doubt whether or not you should take on this case?
“I doubted for a short moment, because it imposes a significant drain on my time, but those doubts quickly vanished.”
“It is a challenge. Whoever wins or loses, this case will go down in history as one of the important trials for freedom of expression.”

“You have to be tolerant about tolerance,” says South African poet Antjie Krog. “There have to be clear regulations about how people deal with one another,” says lawyer Gerard Spong. A court case against Geert Wilders, leader of the far-right PVV, starts next week. Mr Wilders has been accused of discrimination and inciting hate. It’s a case that also explores the boundaries of tolerance.

Krog is a guest at Winternachten, an annual literary festival held in The Hague. In her opening address, she called for tolerance and interconnectedness, the notion that everything and everyone on the planet is reciprocally connected.

There is of course something fundamentally wrong with a society that allows its government to prosecute the government’s leading political opponent for the inevitably arbitrarily-defined crime of “hate speech”, the prosecutors of which avow that truth is not a defense if truth can be deemed hateful. The real question of the Wilders trial

It is not, Did Wilders incite to hatred and discrimination against Muslims? And it is not, Is the government infringing on Wilders’s right of free speech? It is, Shall the Netherlands exist? I recommend a perusal of the long criminal indictment of Geert Wilders for inciting to hatred and discrimination against Muslims (posted at the Hudson Institute site, discussed previously here) as it consists entirely of his own statements about Islam. When his various comments are collected together like this, the consistency, power and truthfulness of his message, including the truthfulness and correctness of his occasional tough language, stands out more than ever. Which means that what he is being put on trial for is true statements about Islam. As I understand it, he is going to argue in court that the truth of his statements is a defense from the charge of inciting to hatred and discrimination. Is it true, as Wilders has said, that the Koran is a Mein Kampf like document that dehumanizes non-Muslims and calls for their destruction? Is it true that the program of Islam is the complete destruction of Western freedom and Western nationhood? Is it true that Dutch people should find this very alarming and that alarmist language is justified? There are various problems with the Dutch law that leave it open to challenge on technical grounds. For example, “incitement to hatred and discrimination” is too vague for a criminal statute, as it makes it impossible for people to know if their behavior is criminal or not, and leaves it up to law enforcement officials to define the law according to their whim, the very definition of tyranny. However, as important as that issue is, my own thoughts on the case tend to focus on a different type of question. When the indictment of Wilders came out in December, and I looked at the charges and the kinds of statements for which he was being charged, I thought:

Wilders is saying that Islam is dangerous and violent, that Islamic immigration should be stopped, that sharia believers should be made to leave. He is calling for discrimination against Islam, which of course I also support. His statements could therefore be reasonably characterized as “incitement to discrimination.” Meaning he is guilty under the law, a law which says you cannot criticize a group that intends the destruction of your country. So let’s have it out. Let’s state clearly that we believe in discrimination against Islam. Let’s have the debate between those who think that discrimination against Islam is necessary to prevent the Islamization of our society, and those who think that it’s criminal to oppose the Islamization of our society.

Advice for Geert Wilders

Dear Mr. Wilders,

I am sorry to hear about your unjust persecution, and have been following it up. I am not a lawyer, but I have been thinking about your case very strongly. As an ex-Muslim woman, I would suggest that you argue strongly for the ‘intention’ i.e motive of your comments. Being brought up as a Muslim woman, I have been brainwashed (dangerously cult-like) since at young age in a persistent culture of hate – starting as young child, to spit at churches. And that the Jews were ‘Satans”! Thus, your comments’ ‘intention’ in criticizing Islam would be to help eliminate such culture of hate in Islam, especially now increasingly controlled by violent extremist Islamist network, including under the leadership of Al-Qaeda; an dto liberate women/girls, agys, converts from Islam and non-Muslims, who are being violated and persecuted using Islam. I was finally de-brainwashed, gradually  due to the culture of liberty that I had been exposed to, ever since coming to the West, and after going into a church, for the first time, at 19 years old, in Canada. But even then, it is a long process due to my upbringing and much torn loyalty to my family, especially my parents. Without such culture of liberty as promoted in the Western civilization, I would not have seek and found out the tragic truth, amidst all the lies that I was brought up in, as a Muslim.

Further,  I also think, you should include Anthropological expert as your witness expert. In order to de-construct’ the racial label behind ‘Muslims’ and ‘Moroccan/immigrants’, since all these labels do not represent a race, and the racially categorizing of ‘Muslims’ is a recent pure political phenomena, and in order to deny the Jewish genuine racial identity, which is socio-cultural identity since biblical times, rather than political.  Moroccans represents a broad category of citizens, not about race. Nor a group of  immigrants either, since it is a complex broad category of diverse people such as of ‘Western’.

I don’t know if this will help at all; and if does not, my apology. But thank you for being a bravely truthful man and politician. Thanks to politicians like yourself, many women/girls, gays, converts from Islam, like myself, and non-Muslims, especially persecuted ones in Islamic/partly Islamic-ruled countries, will be liberated from the most terrible persecution of the 21st. century fascsim ie. Dark Age Islamism!

I was afraid my little talk would be a partypooper. However, to my surprise, all the other speakers said the same thing: we all have to start “being Geert Wilders” instead of just admiring him, then muttering into our coffee about the latest outrage and keeping our heads down.

The trial of MP Geert Wilders on inciting hatred and discrimination charges will resume on February 3, judges in Amsterdam said on Wednesday.

Following yesterday’s initial hearing, judges will now decide who will be called as witnesses and on other procedural motions from both the prosecution and defence.

Wilders’ ended Wednesday’s session by stating that his defence rested not only on freedom of expression laws but the fact he is telling the truth. ‘Something that is true can’t be a criminal offence,’ he was quoted by Nos tv as saying. ‘This is why I ask [the court] to allow my expert witnesses to give testimony. I have to be able to defend myself. I have to be able to show I have spoken the truth.’

All eight other MPs from his anti-Islam party, the PVV, were among the public in court for the hearing. Some 300 supporters had also gathered outside the court building.

Wilders’ witness list includes university professors, radical imams and Mohammed Bouyeri, the man who murdered film maker Theo van Gogh.


Earlier, public prosecutor Birgit van Roessel told the court Wilders’ own testimony will take so long to be heard that he should be first questioned in private by an investigating judge.

Initial extensive questioning about all Wilders’ statements would place ‘a major burden’ on the court, she said. In addition, the hearing will take place in front of a large audience who may react to his statements, she said. So it must be asked if the hearing can take place ‘in the desired order and calm’, she told the court.

The prosecution is not planning to bring any witnesses to the trial, she said.

Wilders’ lawyer Bram Moszkowicz began his defence by calling on judges to halt the trial, arguing the public prosecution department had wrongly brought the case against the MP. He also called for the trial to be moved to the Hague, because that is where Wilders works.

Geert Wilders, the Dutch far-Right MP, has demanded that his race hate trial should hear evidence from the fanatic who used the Koran to justify killing the director of an anti-Islamic film.

It marked an incendiary opening to the landmark case that has divided the Netherlands over the limits of freedom. Mr Wilders, 46, who is accused of incitement and discrimination, asked for 18 witnesses to be called in his defence, including Mohammed Bouyeri, the man who stabbed and shot Theo Van Gogh in an Amsterdam street in 2004.

Radio Netherlands Worldwide – Geert Wilders pulls no punches in courtroom:

Geert Wilders did not pull any punches in a courtroom reaction during the preliminary hearing of his trial on charges of inciting hatred. On the first day of the trial in a courtroom in Amsterdam, a few hundred people protested quietly outside the building, while the lawyers inside presented their plans.

Between two and three hundred people turned up to support Freedom Party leader Geert Wilders. Police were out in force, but had little to keep them occupied. The protesters were well behaved and peaceful. Some even seemed to surprise themselves when they shouted P-V-V as Geert Wilders’ colleague parliamentarians entered the courtroom (PVV are the Dutch initials for the Freedom Party). For the three hours that followed, the atmosphere was relaxed and conversational. This is in stark contrast to the tone Mr Wilders set in the courtroom at the end of the day.

The price of liberty
Speaking to the three judges of the Amsterdam District Court, Mr Wilders gave a rousing oratory on the defence of liberty. He said he has devoted his life to protecting freedom, and is paying the price for it every day. Quoting the third American president Thomas Jefferson, Wilders said eternal vigilance is the price of liberty.

Mr Wilders’ oration was particularly striking in that it followed a day of legalistic to and fro among his defence lawyer, the two public prosecutors, and the senior judge. The preliminary hearing gives the court the chance to learn how the two sides plan to conduct their cases. The trial will start in earnest on an as-yet to be determined date.

Seventeen witnesses
The Freedom Party leader closed his talk with an appeal to the court to allow all seventeen witnesses he would like to call to testify. The public prosecutor had objected to the number, perhaps fearing a months-long seminar on anti-Islamic sentiments.

But Wilders responded by telling the judges: allow all my witnesses, or there can be no question of a fair trial.

This presents the three judges with a challenge. Jan Moors, the senior judge of the three judge panel, indicated in his tone and body language that he wants to be as impartial as possible.

Mister Speaker, judges of the court,

I would like to make use of my right to speak for a few minutes.

Freedom is the most precious of all our attainments and the most vulnerable. People have devoted their lives to it and given their lives for it. Our freedom in this country is the outcome of centuries. It is the consequence of a history that knows no equal and has brought us to where we are now.

I believe with all my heart and soul that the freedom in the Netherlands is threatened. That what our heritage is, what generations could only dream about, that this freedom is no longer a given, no longer self-evident.

I devote my life to the defence of our freedom. I know what the risks are and I pay a price for it every day. I do not complain about it; it is my own decision. I see that as my duty and it is why I am standing here.
I know that the words I use are sometimes harsh, but they are never rash. It is not my intention to spare the ideology of conquest and destruction, but I am not any more out to offend people. I have nothing against Muslims. I have a problem with Islam and the Islamization of our country because Islam is at odds with freedom.

Future generations will wonder to themselves how we in 2010, in this place, in this room, earned our most precious attainment. Whether there is freedom in this debate for both parties and thus also for the critics of Islam, or that only one side of the discussion may be heard in the Netherlands? Whether freedom of speech in the Netherlands applies to everyone or only to a few? The answer to this is at once the answer to the question whether freedom still has a home in this country.

Freedom was never the property of a small group, but was always the heritage of us all. We are all blessed by it.

Lady Justice wears a blindfold, but she has splendid hearing. I hope that she hears the following sentences, loud and clear:
It is not only a right, but also the duty of free people to speak against every ideology that threatens freedom. Thomas Jefferson, the third President of the United States was right: The price of freedom is eternal vigilance.

I hope that the freedom of speech shall triumph in this trial.

In conclusion, Mister Speaker, judges of the court.

This trial is obviously about the freedom of speech. But this trial is also about the process of establishing the truth. Are the statements that I have made and the comparisons that I have taken, as cited in the summons, true? If something is true then can it still be punishable? This is why I urge you to not only submit to my request to hear witnesses and experts on the subject of freedom of speech. But I ask you explicitly to honour my request to hear witnesses and experts on the subject of Islam. I refer not only to Mister Jansen and Mister Admiraal, but also to the witness/experts from Israel, the United States, and the United Kingdom. Without these witnesses, I cannot defend myself properly and, in my opinion, this would not be an fair trial.
